Supreme Court Condemns Barabanki Lawyers’ Hooliganism, Says Legal Profession ‘Tainted’

The Supreme Court of India strongly condemned the acts of violence by lawyers in Uttar Pradesh’s Barabanki district, stating that such misconduct has “tainted and tarnished” the legal profession. The Court not only granted bail to the accused toll plaza employees but also transferred the trial outside the State to ensure fairness.


Background: Barabanki Toll Plaza Incident

The case stems from a January 14, 2026 altercation at the Gotona Bara toll plaza on the Lucknow–Sultanpur highway. The dispute reportedly began when an advocate refused to pay toll charges, which escalated into a physical confrontation with toll plaza employees.

Following the incident, an FIR was registered against the toll staff under provisions of the Bharatiya Nyaya Sanhita, 2023, leading to their arrest.

The situation escalated further when the Barabanki District Bar Association allegedly resolved not to represent the accused employees. Advocate Manoj Shukla, who chose to represent them, faced severe backlash—his office was vandalised and set ablaze by protesting lawyers.


Supreme Court’s Strong Observations

A Bench of Justices Vikram Nath and Sandeep Mehta did not mince words while condemning the actions of the lawyers.

“The legal profession, which was once regarded as a noble profession, has clearly been tainted and tarnished by the acts of hooliganism…”

Violation of Fundamental Rights Under Article 21

The Supreme Court emphasised that the actions of the lawyers directly infringed upon the accused’s right to legal representation and personal liberty.

The Court noted that the accused were compelled to approach the Supreme Court under Article 32 due to the hostile environment created by the Bar.


Key Directions Issued by the Supreme Court

1. Bail Granted to Accused

The Court granted bail to the toll plaza employees, observing that continued detention was unjustified.

2. Trial Transferred to Delhi

To ensure a fair trial, the case was transferred to Tis Hazari Courts, Delhi.

3. Protection to Accused

The Uttar Pradesh Police was directed to ensure the safety of the accused persons after their release.

4. Action Against Erring Lawyers

The Court called upon the Bar Council of India to initiate disciplinary proceedings against those involved in the violence.


This judgment sends a strong message regarding accountability within the legal fraternity. The Supreme Court reiterated that no professional body, including bar associations, can obstruct access to justice.

The ruling reinforces that acts of violence, intimidation, or boycotts by lawyers are unconstitutional and undermine the rule of law.
